Five members of 11KBW are appearing in the Supreme Court tomorrow in what will be the leading authority regarding the application of the National Minimum Wage legislation to employees who are permitted to sleep while at work. In particular, Claire Tomlinson-Blake v Royal Mencap Society and John Shannon v Clifton House, Jaikishan and Prithee Rampersad will determine whether those engaged in “sleep-in shifts” are entitled to the national minimum wage for the entirety of that shift, or just for the period of time such a worker is awake for the purpose of working.
