On 6 and 7 November 2019 the Supreme Court heard Morrisons’ appeal in Various Claimants v Wm Morrison Supermarkets Ltd. The appeal raises novel and important issues concerning employers’ liability for data breaches as a result of the actions of their employees, and the interrelationship of the statutory data protection regime with the common law. The Supreme Court’s decision is likely to be a landmark in the law of both employer’s vicarious liability and data protection.
