In a recent confidential sports arbitration, Daniel Stilitz KC and Michael White acted for a client who had been “bumped” from Team GB’s Tokyo 2021 line-up following a challenge from a teammate.
Having initially been selected to represent Team GB, the athlete was dropped on the order of a review panel, which upheld a teammate’s challenge to the selection decision.
The client appealed to an independent arbitral tribunal, which struck down the review panel’s decision, holding that the original selection had been sound and that the review panel’s decision to reverse it had misapplied the selection rules.
