This afternoon the Divisional Court handed down its long-awaited judgment in R (Hollow) v Surrey County Council [2019] EWHC 618, which was headline news when it was heard in October last year. The case is the leading case in a string of challenges to local authorities’ annual budgets, and it particularly focused on Surrey County Council’s decision to make savings in relation to special educational needs. In a decision with significant implications for local authority budget decision-making generally, the Divisional Court has dismissed the challenge on all grounds.
