There is now a judgment of the High Court providing guidance on the discharge of the public sector equality duty by schools when making exclusion decisions.
In R (TZA) v A Secondary School [2023] EWHC 1722 (Admin), the issues considered include: the respective roles of a head teacher and the governors in discharging the duty; the extent of the duty when the decision at issue is an individual exclusion; and the extent of the duty to explain discharge of the duty at the different stages of the process of challenging an exclusion decision.
