High Court rules OFSTED inspection report unlawful

Peter Oldham KC appeared for the school in R ota Interim Executive Board of X School v OFSTED in which the High Court has today ruled that OFSTED erred in saying that the school breached sex discrimination rules in teaching boys and girls separately. For religious reasons boys and girls are separate during school hours.  OFSTED wrote an inspection report stating that this amounted to sex discrimination against both boys and girls, even though there was no evidence that they were taught differently.  On 1st August, Peter obtained an interim injunction for the school preventing the publication of the report pending trial. The High Court has now ruled at trial that OFSTED was wrong to say that separating pupils amounted to sex discrimination.
