The Business and Property Court in Cardiff has heard, and reserved Judgment, in a case in which Newport City Council applies to strike out proceedings or obtain summary judgment. James Goudie KC is Leading Counsel for the Council, instructed by the City Solicitor. The case has attracted much publicity. It concerns the legal ownership of a hard-drive deposited in a Council landfill in 2013. It is claimed that excavation of the landfill and recovery of the hard-drive in good condition might enable the claimant to recover bitcoin that has significantly increased in value. The Council relies on legislation, including the statutory provision that states that anything that goes into a landfill belongs to the authority.
