John Cavanagh KC appeared for the UK Government in the Court of Justice of the European Union in Luxembourg on 13 June 2018. This is the latest stage in the long-running O’Brien litigation about part-time judges’ pensions. The issue before the Court of Justice is whether a claim can be made in respect of pensions that are attributable to service before 7 April 2000, the date when the Part-Time Workers’ Directive came into force.
