This week, 11KBW members appear on opposite sides of challenges to the Government’s Carbon Budget Delivery Plan – the Government’s strategy for meeting carbon budgets set under the Climate Change Act 2008 and, ultimately, the Net Zero target.
The Plan was produced following the successful claims that challenged its predecessor, the Net Zero Strategy, in 2022: R (Friends of the Earth Ltd & Ors) v Secretary of State for Business, Energy and Industrial Strategy [2022] EWHC 1841 (Admin). The same three Claimants – Friends of the Earth, ClientEarth and the Good Law Project – now allege that the Plan breaches duties under the Climate Change Act to prepare and to report on proposals and policies for meeting carbon budgets.
The claims will be heard from 20-22 February. Jonathan Moffett KC is acting as lead counsel for the Secretary of State, and Peter Lockley is acting as sole counsel for Good Law Project.
