The Investigatory Powers Tribunal (Singh LJ and Johnson J) has today handed down a judgment in Apple Inc v Secretary of State for the Home Department [2025] UKIPTrib 1, a claim and complaint raising issues as to the Secretary of State’s powers to make Technical Capability Notices under the Investigatory Powers Act 2016.
The Secretary of State contended that it would be damaging to national security if the fact or details of the claim, or the identities of the parties, were published. She applied for an order that these details be private and not disclosed. The application was opposed by Apple.
The Tribunal rejected the Secretary of State’s contention that revelation of the bare details of the case would cause the damage asserted, and dismissed the Secretary of State’s application. The judgment is available here.
