Tom Cross KC and Oliver Jackson in challenge to Government’s private school fees VAT policy

Today is the first day of a three-day hearing before a Divisional Court to determine human rights challenges against the Government’s policy to impose VAT on private school fees.

One of the challenges is brought by independent school pupils with special educational needs but without an Education, Health and Care Plan. They argue that the policy breaches their rights under Article 2 Protocol 1 and Article 14 of the European Convention on Human Rights, in short because the policy will cause them to receive education in the state sector which will not be suitable for their needs and the Government does not have justification for including their education within the tax.

The case has been widely covered in the press, including in The Times and the Financial Times.
