Aileen McColgan KC and Jonathan Auburn KC both appeared in the important case of R (Khalsa Academy Trust Ltd) v Secretary of State for Education [2021] EWHC 2660 (Admin), judgment in which has just been handed down by the Administrative Court on 6 October 2021. The case concerned a challenge to the Secretary of State’s refusal to revoke a Directed Academy Order. The judgment examines the Secretary of State’s new policy on forced rebrokerage, and the different policies applying to CoE schools and Catholic schools, as compared with schools of other faiths.
