Stephen Kosmin has been invited to speak on an expert panel convened by the Procurement Lawyers’ Association to address key aspects of the Procurement Act 2023. Stephen will address the scope of permissible modifications under the new Act. Other topics being discussed include:
- scope of the Act;
- the question of statutory interpretation, including how persuasive Cabinet Office guidance might be and relevance of the old caselaw;
- exclusion and debarment; and
- remedies.
Stephen Kosmin acted for the Claimant in James Waste Management LLP v Essex CC [2023] EWHC 1157 (TCC), which is the leading case on modifications under the Public Contracts Regulations 2015.
